Family matters and divorce or separation when a relationship has broken down are usually sensitive and distressing.
Our experience in these areas covers both married and unmarried couples
We have extensive experience dealing with these matters, in particular involving mixed nationality marriages or couples, or foreign nationals living in Spain. Our experience in these areas covers both married and unmarried couples.
We assist with the recognition and enforcement in Spain of foreign decrees of divorce, consent and other court orders
We routinely represent clients before the Spanish courts in consensual and contested divorce proceedings, and proceedings for the division of marimonial assets, as well as in proceedings for interim maintenance, variation of maintenance or child contact arrangements, domestic violance and harassment.
- Advise you on questions such as in which jurisdiction to bring proceedings for divorce or judicial separation, the differences between English and Spanish law (for example, regarding the grounds of divorce, division of matrimonial property, pension sharing) and and the enforceability of court orders made in one country in the other.
- Pre- and post-nuptial agreements
- Tracing of matrimonial assets
- Advise of preserving assets overseas through enforcement of orders in Spain and in overseas jurisdictions.
Where the client, or their husband or wife, protects their assets using trusts, companies or other overseas vehicles, we are experienced in dealing with these structures and the legal and tax issues to which they give rise.
